TERMS AND CONDITIONS OF MOTIVUS-MEMBERSHIPS

1. GENERAL
⁠⁠These terms and conditions apply to the agreement between the person (”Member”) named in the agreement ("Membership Agreement") and Motivus. Motivus has the right to unilaterally amend this Membership Agreement and its terms and conditions for a legitimate reason.

⁠The current membership conditions are always available on the Motivus website. Motivus will notify any material changes to the Membership Agreement by means of a notice on its website thirty days before the change comes into force.

M: All gyms have membership conditions. They cover things like membership, fees and safety. These are the terms and conditions of Motivus-membership.

⁠2. MEMBERSHIP AT MOTIVUS
Motivus is open to people over 18 years of age who are in good general health and who are not at obvious risk of ill health and/or disability.

⁠14–17-year-olds can train with a parent or legal guardian, in which case the parent or guardian is responsible for entering into a Membership Agreement and is responsible for the safety of the minor. The parent or legal guardian must have a valid Motivus membership.

⁠Motivus membership is valid from the date specified in the Membership Agreement. If a binding contract period is specified in the Membership Agreement, the contract is valid for at least the binding contract period. Membership is personal, non-transferable and cannot be used by anyone other than the member.

⁠Membership entitles the member to use the Motivus gym specified in the Membership Agreement.

⁠Motivus’ membership types, concepts and additional services with their descriptions and price lists can be found on the Motivus’ website at https://www.motivus.fi/.

M: You can train with us if you are over 18 and it is safe to do so. 14-17 year olds can only train with a parent or legal guardian. Come and join us together!

⁠3. MEMBERSHIP FEES
Members pay the membership fee, registering fee and any other fees according to Motivus’ applicable prices.

⁠The membership fee is paid at the agreed time in recurring payments. If a Member does not pay by the due date, regardless of the payment method, a collection letter will be sent with a new due date. In the event of late payment, Motivus is entitled to charge costs and interest in accordance with the Debt Collection Act, the Interest Act and other applicable legislation.

M: Motivus does not like to send collection letters to its customers. We find it unpleasant and unfriendly. The best way to handle payments is definitely automatic recurring payment. It's easy and hassle-free. If you have any problems with your payments, please contact us first!

⁠4. MEMBER RESPONSIBILITIES
The Member agrees to read and comply with the Motivus Safety Rules and Code of Conduct and to train safely.

⁠The member respects other members and behaves in a proper manner. We trust you, and together we can train in a way that makes everyone happy.

⁠Motivus is a substance-free gym, and Members undertake not to use intoxicants, drugs or substances classified as doping substances.

M: Be kind and considerate.

⁠5. PERSONAL DATA AND DATA PROTECTION
Motivus always processes a Member's personal data in accordance with our Privacy Policy and applicable law.

⁠Motivus gyms have camera surveillance. The purpose of camera surveillance is to prevent crime and abuse and to ensure the safety of all Members. Camera surveillance is carried out in accordance with the legislation in force.

6. TERMINATION AND AMENDMENT OF MEMBERSHIP AGREEMENT
Members have the right to terminate the Membership Agreement by notifying Motivus within two weeks of signing the Membership Agreement.

⁠Membership can be terminated at any time. The period of notice is four weeks, with the termination taking effect four weeks after the end of the current billing cycle.

⁠Membership can be cancelled by email, contact form, letter or telephone.

M: You have the right under the Consumer Protection Act to terminate your Membership agreement within two weeks. After that, the contract becomes continuous and can be terminated within four weeks. Contact us and we’ll sort it out.

⁠7. DAMAGES, LIABILITIES AND DISPUTE RESOLUTION
At Motivus, the Member is always exercising at his/her own risk. Motivus is not responsible for any injury or damage sustained by a Member while exercising at Motivus. Motivus is not responsible for theft or other loss of a Member’s personal property.

⁠Finnish law applies to the Membership Agreement. Disputes between a Member and Motivus will be settled by conciliation. If this is not possible, either party may take the dispute to court.
