⁠1. GENERAL

These terms and conditions apply to the contract between the person named in the contract ("Customer Agreement") ("Customer") and Motivus. Motivus has the right to unilaterally amend this Customer Agreement and its terms and conditions for good cause.

Updated and current terms and conditions are always available on the Motivus website.

M: All gyms have Terms and Conditions. They cover, among other things, membership, fees and security. These are Motivus' terms and conditions.

2. MEMBERSHIP

The membership of Motivus is valid from the date indicated in the Membership Agreement.

Motivus' Memberships are contracts of indefinite duration, unless otherwise specified in the Client Agreement or in the Product Information.

If a binding contract period is specified in the Customer Agreement, the contract shall be valid at least for the binding contract period. The Customer Agreement is personal and cannot be transferred to another person, nor can it be used by anyone other than the Customer himself.

The membership entitles the member to use the Motivus Gym specified in the Membership Agreement.

The Motivus customer types, concepts and additional services with their associated descriptions and price lists can be found on the Motivus website at https://www.motivus.fi/.

M: Motivus' Membership Agreements are ongoing agreements that can only be used by the person who has purchased the Membership. Welcome to the gym!

3. FEES

Customers shall pay a fee for the product of their choice, a signup fee and any other fees in accordance with Motivus' applicable prices.

The subscription fee is payable on a recurring basis at the agreed time. If the Customer does not pay by the due date, regardless of the payment method, a collection letter will be sent with a new due date. In the event of late payment, Motivus shall be entitled to charge costs and interest in accordance with the Collection Act, the Interest Act and other applicable legislation.

M: Motivus does not like to send collection letters to its customers. We find it unpleasant and unfriendly. The best way to handle payments is definitely direct debit. It's easy and hassle-free. If you have any problems with your payments, please contact us first!

4. DUTIES AND RESPONSIBILITIES OF THE CUSTOMER

The client agrees to read and comply with the Motivus Safety Rules and Code of Conduct and to train safely.

The client will respect the other participants and behave in an appropriate manner. We trust you, and together we can work out in a way that everyone enjoys.

Motivus is a substance-free gym and Clients agree not to use intoxicants, drugs or substances classified as doping substances.

⁠5. PERSONAL DATA AND DATA PROTECTION

Motivus will always process Customer's personal data in accordance with our Privacy Policy and applicable law.

Motivus sports centres are equipped with camera surveillance. The purpose of camera surveillance is to prevent crime and abuse and to ensure the safety of all members. Camera surveillance is carried out in accordance with applicable legislation.

6. TERMINATION AND AMENDMENT OF THE CONTRACT

The contract may be terminated at any time. The period of notice is four weeks, with the termination taking effect four weeks after the end of the current billing period.

Termination may be effected by e-mail.

M: Motivus' Membership Agreements are ongoing and can be terminated within four weeks. Please contact us and we will take care of it.

7. DAMAGES, LIABILITIES AND DISPUTE RESOLUTION

At Motivus, the Customer exercises at all times at his/her own risk. Motivus is not responsible for any injury or damage sustained by the Client while exercising with Motivus. Motivus is not liable for theft or other loss of the Client's personal property.

The Customer Agreement is governed by Finnish law. Any disputes between the Customer and Motivus shall be settled by mediation. If this is not possible, either Party may take the dispute to court.
